The rights and freedoms of the mass media to express and publish are guaranteed and protected under the constitution of Thailand. But such rights and freedoms have their extents and limitations in order to prevent the mass media from using their authorities to violate personal rights of other people, to cause any detriment or to affect the security of the country. If there are no rigid regulations of news presentation and serious realization on a protection of rights and freedoms of a person in the news, the news presentation violating human dignity and human rights will be increased and likely to multiply in the future due to high competition in media businesses and more advance technologies. Therefore, the mass media is now emphasizing a presentational form that penetrates secret information and details of scene, especially on crime news report. But the detail penetration is sometime over emphasized and without consideration of public’s sentiment and undesirable impacts on juveniles, who may imitate such indecent incidents. In addition, to publish photograph of alleged offenders would cause alleged offenders to be unfairly judged by the community even though some of them are still not judged by the court, and it may affect the fair administration of justice process for offenders and injured persons. Therefore, by comparing and studying relevant provisions of foreign laws, a specific law should be enacted to limit the medias’ right to publish offender’s images or to reproduce any criminal scenery which affects the dignity of injured persons. Particular organizations should be established to encourage and provide knowledge for the mass media and general people to realize their own rights and duties. They also have a duty to take a legal action to the mass media that do an offense so that the law can really protect the injured persons.
