วิทยานิพนธ์ฉบับนี้มีวัตถุประสงค์เพื่อศึกษาถึงปัญหาของกระบวนการดำเนินคดีอาญากรณีผู้ต้องหาหรือจำเลยเป็นบุคคลวิกลจริตของประเทศไทย ดังที่ปรากฏอยู่ในประมวลกฎหมายวิธีพิจารณาความอาญา และ พระราชบัญญัติสุขภาพจิต พ.ศ. 2551 และแสวงหามาตรการทางกฎหมายที่เหมาะสมที่จะสามารถนำมาปรับปรุงแก้ไขกระบวนการดำเนินคดีอาญาของประเทศไทยให้มีความสมบูรณ์และทำให้ผู้ต้องหาหรือจำเลยผู้วิกลจริตได้รับความยุติธรรมในการดำเนินคดีอาญามากยิ่งขึ้น จากการศึกษาพบว่า กระบวนการดำเนินคดีอาญากรณีผู้ต้องหาหรือจำเลยเป็นผู้วิกลจริตของประเทศไทยมีความคลุมเครือและไม่ชัดเจนอยู่หลายประการ ประการแรก คือ การไม่มีบทบัญญัติกำหนดกระบวนการตรวจสอบคำสั่งของพนักงานสอบสวนหรือศาลที่สั่งให้ส่งตัวผู้ต้องหาหรือจำเลยผู้วิกลจริตไปควบคุมรักษาในโรงพยาบาลและคำสั่งที่ให้บุคคลผู้นั้นกลับเข้าสู่การดำเนินคดีที่แน่นอน ประการที่สอง คือ การควบคุมตัวผู้ต้องหาหรือจำเลยผู้วิกลจริตไว้รักษาในโรงพยาบาลไม่มีการกำหนดกรอบระยะเวลาในการควบคุมตัว และประการสุดท้าย คือ ความไม่ชัดเจนของสิทธิในการมีทนายความของผู้ต้องหาหรือจำเลยผู้วิกลจริต ซึ่งความไม่ชัดเจนของกระบวนการดำเนินคดีอาญาทั้งหลายเหล่านี้เป็นเหตุให้ผู้ต้องหาหรือจำเลยผู้วิกลจริตไม่ได้รับความคุ้มครองสิทธิในการดำเนินคดีอาญาเท่าที่ควรและอาจก่อให้เกิดความไม่ยุติธรรมในการดำเนินคดีได้ ด้วยเหตุที่ได้กล่าวมาในข้างต้น จึงขอเสนอให้แก้ไขเพิ่มเติมประมวลกฎหมายวิธีพิจารณาความอาญา และพระราชบัญญัติสุขภาพจิต พ.ศ. 2551 โดยกำหนดให้มีการบัญญัติกระบวนการออกคำสั่งให้ส่งตัวผู้ต้องหาหรือจำเลยผู้วิกลจริตไปควบคุมรักษาในโรงพยาบาล คำสั่งให้ดำเนินคดีต่อไป และคำสั่งที่ให้บุคคลผู้นั้นกลับเข้าสู่การดำเนินคดีภายหลังเข้ารับการรักษาเป็นลายลักษณ์อักษรที่แน่นอน รวมถึงเปิดโอกาสให้ผู้ต้องหาหรือจำเลยผู้วิกลจริตสามารถโต้แย้งความถูกต้องของการออกคำสั่งดังกล่าวได้ กำหนดกรอบระยะเวลาในการควบคุมรักษา และกำหนดให้ผู้ต้องหาหรือจำเลยผู้วิกลจริตทุกคนจะต้องมีทนายความให้ความช่วยเหลือในการดำเนินคดีทุกกรณีตลอดการดำเนินคดี ซึ่งมาตรการเหล่านี้จะส่งผลให้ผู้ต้องหาหรือจำเลยผู้วิกลจริตได้รับการคุ้มครองสิทธิในการดำเนินคดีอาญาอย่างแท้จริง
The objectives of this research are to study about problems of Thailand’s criminal procedure in case of alleged offenders or defendants who are mentally ill as they appear in Code of Criminal Procedure section 14 and Mental Health Act, B.E. 2551, and also searching for the appropriate legal measures which can use to improve Thailand’s criminal procedure to be more complete and making the alleged offenders or defendants get more justice in criminal procedure. According to studies, it has been found that Thailand’s criminal procedure in case of alleged offenders or defendants who are mentally ill is ambiguous and unclear in many aspects. Firstly, there are no provisions about the process of verifying an order to send the alleged offenders or defendants to hospital for controlling and treatment and order to bring them back into prosecution. Secondly, there are no time frames about controlling the alleged offenders or defendants in the hospital. Finally, the right to counsel of the alleged offenders or defendants is unclear. The lacks of clarity in these criminal procedures cause the alleged offenders or defendants will not be protected in criminal procedures as they should be, and may cause unfairness in the cases. For these reasons, this research recommends to amend Code of Criminal Procedure and Mental Health Act, B.E. 2551 by establishing provisions about the process of verifying an order to send the alleged offenders or defendants to hospital, order to continue proceeding and the order to bring them back into prosecution including the opportunity for the defendant to dispute the accuracy of these orders, setting time frames about controlling the alleged offenders or defendants in the hospital, and specifying that all of alleged offenders or defendants who are mentally ill will be required to have a lawyer throughout the litigation process. These legal measures will result in the alleged offenders or defendants who are mentally ill being properly protected in the course of criminal proceedings
