The purposes of this study are to explore the concepts, purposes, and model to decriminalization of drug cases from Thailand and foreign countries, and to find the factors contributing to the concept of decriminalization of drug cases. This study is a qualitative research applied on documentary research and in-depth interview from 10 stakeholders who are involved in policy process.
The results showed that the decriminalization of drug cases is a concept that aims to change the view of drug addicts is the "patient" doesn’t be the "criminal" to receive appropriate medical treatment instead of being prosecuted by the criminal justice system which assisted the administration of criminal justice to be more effective.
The key factors that encourage the decriminalization of drug cases have been defined as a policy are the drug problem intensified in all areas of the country that make all sectors of society recognized the necessity of decisive measures to resolve the problem, causing case backlog and overcrowding issues later. As a result, relevant agencies need to seek other measures to solve those problems combined with the experiences from foreign countries which has been developed the decriminalization of drug cases as a policy to suppress drug. The serious drug problem and experiences from foreign countries are the major influences in defining policy agenda in Thailand. Later for the policy formulation, knowledge associated with decriminalization of drug cases has been developed to be implemented effectively. In addition the policy actor, the political leader with a strong leadership is able to decide his own policy. All relevant agencies also have same understanding in decriminalization of drug cases policy. As a result, there is no conflict between the agencies and all agencies recognized the benefits from the policy.
Therefore, to promote and encourage all sectors to recognize the importance of decriminalization of drug cases is an important part for supporting and setting a policy agenda to achieve sustainable solutions.
