This research is aimed to study on how to separate public service functions and authorities between state and local government organizations in accordance with the “Determining Plans And Process Of Decentralization Act, B.E. 2542, which is amended by the Constitution of the Kingdom of Thailand, B.E. 2540; Chapter 9 Local Government. For ten years of law enforcement, the substance of law has been remaining defective to categorize public service providing authority between state and local government organizations. Firstly, it lacks of principle on how to separate functions and authorities between central, regional and local government in providing public service. Secondly, this law is not a special law, so it can not over rule another against law which duplicate in functions and authorities. Besides, the Decentralization Committee has inadequate power to enforce law and drive Decentralization Plan fluently and successfully. The recommendations of the thesis are as followings; (1) To define the scope of functions and authorities by clarifying type and level of each public service in handling of state and local government organizations including linkage between them (2) To restructure for authority of the Decentralization Committee in order to enforce law efficiently (3) To appoint a Separation of Functions and Authorities in Providing Public Service Tribunal, upon the Decentralization Committee’s recommendation, in order to consider problems and controversies on separation of functions and authorities in providing public service before administrative court procedure.
