Thesis is a creative work of the author that needs an identical talent persistency, endeavor and many resources to create a work that benefit society. At the present time. The problem concerning the ownership of copyright on the thesis works in Thailand as between the student and the University, has no definite problem and is an issue commonly discussed among lawyers. Various reasons are asserted according to either the opinion that the thesis belongs to the University, or alternately the student however, it's still can't find certain conclusion about this problem. So it's necessary to raise this problem to research. The objective of this study is to find the answer who is the copyright owner on the thesis by studying Thai Copyright Act B.E.2537 Foreign Copyright Laws and other related laws as well as comparision with regulation and procedure of thesis management in several countries so as to analyze whether the existing problem about the ownership of the thesis has provided adequate protection for the author or not. From the study revealed that according to the procedures of thesis management and the nature of thesis work in several Universities in and out of countries as stipulated by the curriculum, the student himself was charged with management all pant of the thesis Therefore. The conclusion of this problem is that the copyright ownership of the thesis works shall belong to the student. The student should have the right as a copyright owner according to the copyright Act of Thailand B.E. 2537. However if the thesis research is performed in whole or in part utilizing equipment or facilities or funds provided by the university under conditions that impose copyright restrictions in this case the copyright on thesis should belong to the university and the student.
