To study the trade practices in retail business, particularly on the trade practices of the discount stores where now have extremely expanded. This event has the strong impact to the retail businesses in Thailand. According to this studying, the discount stores have developed the information technologies, own distribution system goods and the expansion of their branch which are making the economies of scale. As a result of that, it appears that discount stores have the highly buying power and unfair trade practices to buy the goods for instance: asking for the over discount, expense and other fees from supplier, using this advantage by having the unfair trade practices to seize the market portion. Furthermore, discount stores have sold the goods at loss and have price discrimination, which violates the Competition Trade Act B.E. 2542 article 29. Nevertheless, such practices have occurred as because this kind of business has the extreme competition, which stipulate the good effect to the consumer. Therefore, such practices can be both of the damaging of competition and the good effect for economy at the same time. The author would like to propose that there should be the amendment of article 29 of the Competition Act B.E. 2542 by adding the principle of the applying the approval from the competition commission for the necessary and reasonable unfair trade practices as for the flexibility of the law practice.
