Public hearing is one of measures in controlling state power, as well as, an instrument in promoting political public participation in democracy regime. However, public hearing in Thailand cannot successfully achieve such goals. The purposes of this research is to study the principles and methods of public hearing including its weak points. This is illustrated through the study of regulation of the Office of the Prime Minister on Public Consultation by Public Hearing, B.E. 2539, its applications and problems on public hearing situation in Thailand. The research is done by documentary study, comparative study by comparing regulations of USA, England, and France on public hearing, and selected five case studies. The suitably alternative solutions are recommended. The research output shows that regulation of the Office of the Prime Minister on Public Consultation by Public hearing, B.E. 2539 is still vaguely exercised especially on the projects of the state and the period of public hearing's arrangement. Those lead to the misinterpretation. Some parts are related to the principles of public hearing ; method of the selection and components of public hearing committee ; public hearing committee's responsibility in public hearing report ; and confidence of public in public hearing process. From this research, it was found that problems on adjustment public hearing with Thai society and perception of Thai people is still limited, therefore, led to misunderstanding in the meaning of public hearing. The research's recommendations are as follows: definition of "projects of the state" to be well defined; suitable period to arrange public hearing to have less unclear interpretation ; correction on component, source, and power of the public hearing committee to be able to unfoldd the public hearing report ; and organizing public hearing to be documentary, not confrontational and proportionally set up by representative of each side to the public hearing. Finally, supporting knowledge and creating better understanding, as well as, developing the public process giving more chance to all parties to participate in public hearing as much as possible will be long term solution.
