ปัญหาผลทางกฎหมายของนิติกรรมเกี่ยวกับทรัพย์สินของผู้เยาว์ที่ผู้ใช้อำนาจปกครองกระทำไปโดยฝ่าฝืนมาตรา 1574 แห่งประมวลกฎหมายแพ่งและพาณิชย์ / ลัษมณ วิริยะงามวงศ์ = Problems concerning legal effect of juristic acts with regard to the property of the minor which a person exercising parental power enters into in violation of section 1574 of the Civil and Commercial Code / Lussamon Viriyangamwong
The section 1574 of the Civil and Commercial Code provides thirteen types of juristic acts with regard to the property of the minor which a person exercising parental power needs an authorization by the court in order to enter into such acts in the name of minor. However, the provision does not specific a legal effect of the act entered into without authorization, causing different ruling of court decisions regarding legal effect of the acts and relating issues without making persuasive precedent, which reflects uncertainty, injustice between related parties, and especially inability to protect the minor’s interests as intended by the law. Regarding this concern, the study gathers opinion amongst the scholars and the Supreme Court’s judgment, and performs comparative analysis focusing on similar legal provision of the Federal Republic of Germany, the French Republic and the Italian Republic in several issues: legal effect of the juristic acts, annulment of the acts by the court, avoidance of the acts, confirmation of the acts, ratification of the acts, return of the properties, and compensation. Hence, the study suggests an amendment to the section 1574 of the Civil and Commercial Code should be undertake to contain “ineffective to the minor” as a legal effect of the juristic acts entered into without authorization, including supplement the provisions regarding confirmation of the acts, ratification of the acts, return of the properties, and compensation under a new Title 5 “Ineffectiveness” in the Civil and Commercial Code Book 1 “General Principles”, Title 4 “Juristic Acts”
