Every country which has a judicial institution with the duty to dispense justice according to the law generally has its own unique procedure for trying the case. The characters of the trial procedure of each country depends very much on the history and development of the national judicial system, including such other factors as customs, traditions, and the ways of life of its members. However, it must be able to demonstrate to the public that by applying such trial procedure, justice is being done to both parties to the case. The jury system is a trial procedure which practice in the Common Law countries, and it has been closely identified with Britain, so much so that it is taken that the jury system originated in that country. However, the jury system in Britain has evolved and developed over a long period of time before it is generally accepted that the system of trial by jury in Britain is capable of dispensing justice to both parties to the case. In other Common Law countries, the jury system has been adopted with some modifications i.e. the United States of America adopted the jury system of the British model with certain modifications so that the system is suitable for the social, economic and political conditions of the United States. Even the countries with codified legal system such as France and the Federal Republic of Germany have adopted the jury system but they also modified it, so that it can fit neatly into their legal system. Though Thailand which has a codified legal system with its own unique judicial and trial system, did not adopt the jury system, it is widely accepted that the system of trial by jury is very capable of dispensing justice to the parties to the case. If the advantages of the jury system are adopted and used in the process of reforming the law on the trial procedure of Thailand, both parties to the case may feel and accept that all have been done to grant both of them justice equally. This feeling and acceptance will elevate the judicial system into its proper place of great respect and thereby strengthen the security of the nation.
